WHY YOU FEEL SLEEPY AFTER MEAL

WHAT IS FOOD COMA

INTRODUCTION:

Sleeping after eating, known as postprandial somnolence or a "food coma", "Post-Meal drowsiness," is a common, often natural, dip in energy occurring 30 minutes to a few hours post-meal. It is a normal physiological response triggered by large, high-carb/fat meals, increased blood flow to digestion, or hormonal changes. Experts recommend waiting 2–4 hours after eating before lying down to prevent indigestion.

THREE REASONS WHY YOU FEEL SLEEPY AFTER EATING AND HOW TO AVOID IT

Feeling sleepy after a meal, especially a large or carb-heavy one, is common. Here's why:

1. Blood Flow Shift: Digestion prioritizes blood flow to the stomach, reducing it to the brain, causing fatigue. After eating, the body prioritizes digestion. Blood flow increases to the stomach and intestines to support the breakdown and absorption of nutrients.

As more circulation is directed toward the digestive tract, there may be a relative decrease in blood flow to other areas, including the brain. While this shift is temporary and well-regulated, it can contribute to reduced alertness and a feeling of fatigue

2. Carbs and Hormones: Carbs trigger insulin, moving tryptophan to the brain, converting to serotonin (relaxation) and melatonin (sleep).

Meals rich in carbohydrates such as rice, bread, pasta, and other refined grains trigger the release of insulin. Elevated insulin levels facilitate the movement of the amino acid tryptophan into the brain.

Once in the brain, tryptophan is converted into:
1) Serotonin – a neurotransmitter associated with relaxation and mood stability
2) Melatonin – a hormone that regulates sleep cycles

The combined effect promotes calmness and increases the likelihood of feeling sleepy after eating

3. "Rest and Digest" Mode: The parasympathetic nervous system promotes relaxation, slowing heart rate and digestion.

The body’s parasympathetic nervous system often referred to as the “rest and digest” system becomes more active after meals.

What this system does is that :
• Slows heart rate
• Reduces blood pressure
• Enhances digestive activity
• Promotes a state of relaxation

As a result, the body naturally shifts toward a calmer, less alert state

WHY LYING DOWN IS A BAD IDEA:

- Slows digestion
- Causes bloating, acid reflux, and discomfort

While feeling sleepy after eating is normal, lying down immediately can interfere with digestion.

Potential effects include:
• Slower gastric emptying
• Bloating and fullness
• Acid reflux or heartburn
• General abdominal discomfort

When you lie flat, gravity no longer helps keep stomach contents in place, increasing the risk of acid moving back into the esophagus

WHAT THEN TO DO:

- Stay upright for 20-30 minutes post-meal
- Take a light walk
- Avoid overly large or high-refined-carbohydrate meals
- Eat balanced meals with protein, fiber, and healthy fats to stabilize energy levels

BOTTOM LINE:

Post-meal sleepiness is a natural and common response. However, frequent excessive drowsiness after eating may sometimes indicate issues such as blood sugar fluctuations or poor meal composition. Adjusting portion sizes and food balance can significantly improve post-meal energy leve.

Disclaimer: If you experience extreme or persistent sleepiness that interferes with daily life, it may be due to conditions like diabetes or insulin resistance and should be discussed with a doctor

WHY WOMEN EASILY GAIN WEIGHT: 8 KEY FACTORS

Many women notice weight gain despite normal eating habits. Here are the main causes:

1. Hormonal Changes: Estrogen, progesterone, and thyroid hormones impact fat storage and metabolism. Imbalances can lead to weight gain, especially around the waist and hips.
2. Slow Metabolism: Some people naturally burn fewer calories, leading to gradual weight gain even with normal food intake.
3. Stress: High cortisol levels encourage belly fat storage and cravings for unhealthy foods.
4. Poor Sleep: Lack of sleep affects appetite hormones, increasing hunger and calorie intake.
5. Sedentary Lifestyle: Sitting for long hours or infrequent exercise reduces calorie burn, promoting weight gain.
6. Unhealthy Eating Habits: Consuming processed foods, sugary drinks, and high-fat meals contributes to weight gain.
7. Medications: Certain medications, like antidepressants, steroids, or birth control, can affect appetite or metabolism.
8. Age: Decreasing muscle mass and slowing metabolism with age make weight gain more likely.

Manage Weight with These Tips:

- Eat balanced meals with veggies, protein, and fiber
- Stay physically active
- Get enough sleep
- Manage stress through relaxation or mindfulness
- Monitor portion sizes and limit sugary foods

SIGNS YOU'RE BODILY HEALTHY:

A healthy body functions optimally through a combination of balanced nutrition, regular exercise, adequate sleep, and mental well-being, rather than just the absence of disease. Key habits include eating varied, nutrient-dense foods (fruits, vegetables, lean protein), staying active, hydrating, avoiding harmful substances, and managing stress

The following are 8 signs you are in a healthy body:

1. Your poop sinks in the toilet (good nutrient absorption)
2. Your tummy's flatter in the morning (reset digestion and inflammation)
3. Your armpit has a natural scent (not B.O.)
4. Cuts or bruises heal fast (strong immune system)
5. You handle cold well (good metabolism and brown fat)
6. You sigh randomly (body's internal reset button)
7. Your belly rumbles when hungry (gut's cleaning cycle)
8. Your pee is light yellow (hydrated and balanced)

THE MATING RITUAL OF SNAILS: A TESTAMENT TO GOD'S UNMATCHABLE CREATIVITY

Introduction
Ladies and gents, lets come down a little lower. This is a period of humility of course so DWI take to a special world of one of the magnificent creatures. The snails.

The Mating Behavior of Snails

Have you ever noticed this behaviour in snails? If yes, then what do you think is really happening the moment you discover two or more snails in this situation? Whatever your responses are, i want to open you heart to one of the secrets of life that reoccurs slowly but gracefully on our planet without our permission.

Have you ever observed two snails connected by a whitish duct or tube? This is a natural process where they're exchanging sperm packets, a process crucial for their reproduction. Let's dive into the details:

> What you see above is snails connected with each other by a whitish duct (or tube), it means they are mating. This white structure is their reproductive organ emerging from the side of their head. It is a natural process where they're exchanging sperm packets, a process crucial for their reproduction.

Let's dive into the details:
Here is what is happening during this process:

Simultaneous Mating: Snails are hermaphrodites, meaning they possess both male and female reproductive organs. When they connect, they are usually exchanging sperm with each other simultaneously, aiming to fertilize each other's eggs.

The "Love Dart": In many land snail species, this mating is preceded by shooting a "love dart" (a hard, calcium-based projectile) into the partner. This injection of hormones helps increase the likelihood that their sperm will be used for fertilization rather than digested. :

The White Duct is Reproductive: The "whitish duct" or "tubular tissue" is actually the everted reproductive organ (penis/genitalia) of the snails, which extends from a pore on the side of their head.
Love Darts: In many species, like the common garden snail (Helix aspersa), this mating is preceded by shooting a calcium "love dart" into the partner to increase reproductive success. The white duct you see is the culmination of this courtship, where they exchange sperm.

What to Expect: The snails may remain joined in this way for several hours. After this process, both snails will likely lay eggs to increase the population.

Safety: The snails are not harmed by this; it is a natural part of their reproductive cycle. Do not try to separate them, as this can cause injury or death.

Duration: The mating process can last for several hours, with the snails staying attached for up to two hours or more particularly at night.

Post-Mating: After this interaction, both snails will likely lay eggs.

Conclusion

Snail's lifestyle is a testament to God's amazing creativity. Tho very small and fragile yet a living creature with jaw dropping secrets. Our creator made it all

Final Words

Now why does this concerns you? The natural phenomena have been in various aspects telling us the vast wisdom of YAHWEH the FATHER and CREATOR of all. Every living creature in there own uniqueness has a way of bringing GOD to our attentions (Psalm 104:24, Proverbs 30:24-28).

Studying the Scriptures apart, but several occasions, these smaller living beens have in a spectacular manner, redirect us back to the on and only GOD by manifesting his excellent through their daily lives invulnerability through instincts.
> As humans made in His image, how well are we reflecting His glory, conducting His goodness, and radiating His love? How well is our attentions drawn to Him? Is our understanding of nature drawing us closer to Him?

Let this questions resonate with you as we continue in this period of fasting and spiritual reflection. Remember, we're made feom dust and to dust we shall return, but before then, our lives must speak of HIS greatness. Amen!

EUROP IN PROPHECY

THE IRON AND THE CLAY NATIONS

0n May 29, THE French-in a legally binding referendum-rejected the proposed European Union constitution. Three days later, a Dutch referendum submitted an even more dogmatic rejection of the charter. These two events are fulfilling a major prophecy about end-time Europe that few understand.

The all-important key to under- standing Bible prophecy-and, by extension, world events-is identifying Israel in those prophecies.

Herbert W. Armstrong's book The United States and Britain in Prophecy explains, in thorough, riveting detail, how the Americanand British peoples largely fulfill this prophetic role.

When you understand that the U.S. and Britain are the descendants of Ephraim and Manasseh, upon whom the birthright of Israel was conferred millennia ago (see Genesis 48:16-20), world events leap into focus. Ephraim and Manasseh were sons of Joseph, who was one of the patriarch Israel's 12 sons. The descendants of another of Israel's sons, Judah, now inhabit the small nation in the Middle East called Israel.

Identifying Israel's descendants is not only vital to understanding the Anglicized world and the Middle East in global affairs, it is also crucial to understanding European events, because Israel's other 10 Sons inhabit mainland Europe today.

The united Europe we see today is currently composed of Israelite nations as well as non-1sraelite (or Gentile) nations. That awkward mixture is at the heart of Europe's woes. Believe it or not, this was prophesied in your Bible!

Daniel 2 contains a prophecy of four major world-ruling kingdoms that would exist from the reign of Nebuchadnezzar's Babylon down to our day. This prophecy is described through a visual aid-a great image of a statue with head of gold (the Babylonian empire), breast and arms of silver (the Medo-Persian empire), belly and waist of brass (the Greco-Macedonian empire) and two legs of iron (the Roman Empire).

The feet and the toes of this image, however, show the iron mixing with "miry clay" (Daniel 2:43).

God tells Israel, in Jeremiah 18:6, that He is the potter and it is the clay.

Notice how this clay will affect the final resurrection of the Roman Empire, which we see rising in Europe today currently under the name of "European Union": And whereas thou sawest the feet and toes, part of potters' clay, and part of iron, the kingdom shall be divided; but there shall be in it of the strength of tne iron, forasmuch as thou sawest the iron mixed with miry clay" (Daniel 2:41).

Yes, this final resurrection of the Roman Empire will have the strength of the previous empire, but there's more. Verse 42: "And as the toes of the feet were part of iron, and part of clay, so the kingdom shall be partly strong, and partly broken [or brittle]".

How brittle is the European Union today? What is the cause of this divisiveness? Well, just take a look at the nations creating the fuss over the EU constitution as a characteristic example.

There has never been more turmoil over Europe's constitution-even the Union's very existence than in the months leading up to the French referendum on whether the nation should ratify the document. Poll after poll showed that the French would reject the treaty, even if narrowly. This sent Europe into a panic. Eurocrats scrabbled up all sorts of ideas--from helping the French leadership campaign for the treaty to devising a plan B should the French reject it. One plan was to let the rest of Europe ratify it and then take it back to the French a second time (Denmark needed a repeat referendum over the 1992 Maastricht Treaty; Ireland likewise for the 2002 Nice Treaty). Germany did all it could to help the effort; it completed its own parliamentary ratification process just two days earlier, hoping that would help boost French support.

France (modern-day Reuben) couldn't reject it, or so many insisted, for France was a founding member-and a core one at thatof a European federation. Adding insult to injury, three days after the French rejected the constitution, Holland (Zebulun's descendants), another founding member of the united-Europe idea, gave an even more resounding "nee in its referendum. This too was disheartening to European policymakers.

Notice too which other nations have provoked fear among Europhile politicians, who so desperately want their charter to be implemented. Far-right parties in Belgium (Asher) campaigned hard against the constitution, which is one of the reasons Belgium decided not to have a referendum. Britain and Denmark (modern-day Dan) actually suspended their plans to havea referendum on the constitution.

In fact, as far as taking the matter to the people, of the 10 European nations that originally planned to do this, six are Israelite nationscountries more rooted in the Judeo-Christian way of thinking. And the countries that had already ratified the treaty by the week of the French and Dutch referenda were all non-Israelite.

Bible prophecy stands revealed in Europe! Israel certainly is the clay" in this union of nations. It is mixing with the strength of iron and making the resulting union brittle.

Where Are They Now?

The 12 biblical tribes of Israel and what nations they primarily make up today.

Reuben = France

Simeon = Scattered

Levi = Scattered

Judah = Israel

Zebulun = The Netherlands

Issachar = Finland

Dan = Denmark, Ireland

Gad = Switzerland

Asher = Belgium, Luxembourg

Naphtali = Sweden

Joseph = United States/G. Britain

Benjamin = Norway

This final resurrection of the Roman Empire, though strong as iron, will be short-lived because of its unnatural composition. As Daniel 2:43 states, "But they shall not cleave one to another, even as iron is not mixed with clay." Letting the Bible interpret itself in identifying the "clay' we can know that some Israelite nations will be involved in a united Europeat least for a period of time. We can be sure Britain will not be, however, as the Bible prophesies it will be one of the major victims of the European conglomerate. The point here is that what presently WEAKENS the iron -nature of this empire are the nations that are "clay'as we can see is the case today.

But before its collapse, a united, iron-strong Europe will dominate this world-and it will directly impact your life. Though it will be for only a short time, these nations of iron and clay will unite under one strong political leader. 3 Modes Of Leadership That You Must Know

PARENTHOOD IS LIFELONG

Parenting is on important aspect of leadership. Inability of some parents to execute the role of leadership appropriately has contributed to the social menace we're experiencing today. Please read the attached story below:

"Every month, MartΓn's parents took a trip to visit Grandma and returned on the same train the next day. One day, MartΓn asked, "I'm grown up now. Can I go to Grandma's alone?"

After a short discussion, his parents agreed. They stood with him as he waited for the train to depart, offering final pieces of advice through the window. MartΓn, feeling confident, reassured them, "I know, I’ve heard this a thousand times."

Just before the train left, his father leaned in and whispered, "Son, if you feel bad or insecure, this is for you," slipping something into his pocket.

Now, MartΓn was on his own for the first time, sitting on the train just as he had wanted. At first, he admired the passing landscape, but soon he became uneasy. Strangers bustled in and out, creating noise, and one person even looked at him with sympathy.

The conductor made comments about him being alone, and gradually, fear crept in. He felt trapped, unsure of himself.

With tears in his eyes, MartΓn remembered the item his dad had placed in his pocket. Trembling, he pulled out the piece of paper and unfolded it. It simply read, "Son, I'm in the last train car."

This is how life works. At so useful point we must allow our children to explore new experiences and face challenges on their own. But, as parents, we always remain close, in the background, ready to support them if they are afraid or encounter obstacles. We stay near them for as long as we live, watching over them, quietly ready to help."

Ladies and gentlemen, our heavenly FATHER have all the three and demonstrating it- from the beginning of creation till present and has passed the trait to all that he created.

True leadership can be done in 3 exemplary ways and executive positions: FRONT, SIDE and BACK.

Musical Legend: Majek Fashek

INTRODUCTION

Majekodunmi Fasheke, widely known as Majek Fashek (March 1963 – June 1, 2020), was a Nigerian singer-songwriter and guitarist. His 1988 album, Prisoner of Conscience, featured the hit single "Send Down the Rain," which earned six PMAN Music Awards. Also referred to as The Rainmaker, he collaborated with numerous artists globally, including Tracy Chapman, Jimmy Cliff, Michael Jackson, Snoop Dogg, and BeyoncΓ©.

EARLY LIFE

Fashek was born in Benin City in 1963 to an Edo mother and an Ijesa father, although he primarily identified with his Benin heritage. Various interpretations of his name, Fasheke (IfΓ‘ Γ  αΉ£e Γ¨kΓ©), include "powers of miracles" and "divination does not lie." It is associated with the orisha (deity) Ifa, the deity of divination in the Yoruba religion, and translates to "Ifa does not lie or deceive." Following his parents' separation, Fashek stayed in Benin City with his mother and later joined the choir at his local Aladura church, where he learned to play the trumpet and guitar while composing songs for the choir.

MUSICAL CAREER: EARLY 1980s: JAH STILL

In the early 1980s, Fashek, then performing under the stage name Rajesh Kanal, joined the group Jah Stix alongside musicians Amos McRoy Gregg and Black Rice. The trio quickly gained fame as the in-house band for the NTA Benin show Music Panorama and toured with fellow reggae group The Mandators, led by Victor Essiet. Jah Stix also served as session musicians for emerging reggae artist Edi Rasta, later known as Evi-Edna Ogholi.

1987–1990: PRISONER OF CONSCIENCE AND I&I EXPERIENCE

After Jah Stix disbanded in 1987, Fashek, now known as Majek Fashek, signed with Tabansi Records and embarked on a solo career, releasing the album Prisoner of Conscience. He quickly rose to prominence as Nigeria's leading reggae artist after "Send Down The Rain" became the year's most popular song. In 1989, he won six PMAN awards, including "Song of the Year," "Album of the Year," and "Reggae Artist of the Year." His subsequent album, I&I Experience, was released in late 1989 under the Tabansi label and featured the anti-apartheid anthem "Free Africa, Free Mandela," which sampled Steam's "Na Na Hey Hey Kiss Him Goodbye."

IN 1991:

The song 'So Long' and American Invasion
After departing from Tabansi Records, Fashek signed with CBS Nigeria in the early 1990s and released So Long Too Long, which was included in Putumayo World Music's debut album. In 1990, he signed with Interscope Records and released the critically acclaimed album Spirit Of Love, produced by "Little Steven" Van Zandt. In 1992, he appeared on Late Night with David Letterman, performing "So Long Too Long" for the television audience. Flame Tree released The Best of Majek Fashek in 1994. He was later dropped by Interscope but moved to Mango, a division of Island Records, known for marketing reggae internationally. His first album for Mango included a cover of Bob Marley's "Redemption Song," and he recorded several albums for various labels thereafter, including Rainmaker for Tuff Gong (1997) and Little Patience for Coral (2004).

MUSICAL STYLE

Fashek's musical influences included Bob Marley, whom he vocally resembled, Jimi Hendrix, and Fela Kuti. He was among the original Nigerian artists attracted to Caribbean music, particularly reggae, rather than indigenous genres like fuji and jΓΉjΓΊ. He was known for blending these styles to create his unique genre, termed kpangolo, and the song "My Guitar," an homage to his favorite instrument, was heavily influenced by rock.

OTHER WORKS

Fashek had a supporting role in the 1999 Nollywood film Mark of the Beast and appeared in a commercial for the non-alcoholic beverage Diamalt. In 2016, he performed for an audience of over 10,000 at a comedy show hosted by Ayo Makun at Eko Hotel Hall in Lagos.

In November 2016, Fashek contributed the song "We Are Not Afraid" to a video directed by former 10CC member Kevin Godley, featuring over 200 celebrities, including 53 members of the Rock and Roll Hall of Fame, to raise funds for the International Rescue Committee (IRC) and Human Rights Watch (HRW).

PERSONAL LIFE

Fashek was married to Rita Fashek, who inspired the song "Without You." The couple had four children but later divorced. In 2015, it was revealed that Fashek was bankrupt and battling drug addiction. After admitting he needed help, he entered a drug rehabilitation center in Abuja, where he recovered and returned to music.

DEATH

In addition to his struggle with drug addiction, Fashek faced other health issues that necessitated hospitalization on several occasions. Rumors of his death circulated in September 2019, but his manager confirmed that he had been critically ill, hospitalized at Queen Elizabeth Hospital in London, and in urgent need of financial assistance. Billionaire businessman and philanthropist Femi Otedola pledged to cover all of the singer's medical expenses.

Fashek passed away in his sleep on June 1, 2020, in New York City. He was 57 years old and was battling esophageal cancer.

THE HUNGRY AND THE ANGRY

WHEN YOU ARE HUNGRY AND WHEN YOU ARE ANGRY

Journal from the desk Chief Editor of DWI
Date: March 15, 2023

Nigeria President
President of the Federal Republic of Nigeria:
Bola Ahmed Tinubu

Today, I stumbled upon a thought-provoking concept that has been lingering in my mind since the beginning of the ongoing protests in Nigeria and across the globe:  the distinction between the hungry and the angry. It's a subtle but profound difference that can have significant implications for our interactions and our overall well-being.

DaveMusic is one of the subsections of DWI which deals with music/entertainment. Here's what you need to know... READ MORE HERE

THE HUNGRY

The hungry are those who are driven by a genuine need. They are motivated by a desire to fulfill a basic human requirement, such as food, shelter, or security. Their hunger is not a fleeting emotion but a deep-seated longing that compels them to seek sustenance.

When we are hungry, we are often more focused and determined. We are willing to work hard and persevere to meet our needs. We may even be willing to compromise or sacrifice in order to achieve our goals.

There are several different types of hunger, each with its own unique characteristics and causes:

Stomach Hunger: This is the most basic type of hunger, and it is caused by a lack of food in the stomach. It is often accompanied by feelings of emptiness, rumbling, and gnawing in the stomach.
Intestinal Hunger: This type of hunger is caused by a lack of nutrients in the body, even if the stomach is full. It can be caused by malabsorption disorders, such as celiac disease or Crohn's disease, or by a diet that is deficient in certain nutrients.
Cellular Hunger: This type of hunger is caused by a lack of oxygen and glucose at the cellular level. It can be caused by conditions such as diabetes, heart disease, or cancer.
Psychological Hunger: This type of hunger is caused by emotional factors, such as stress, anxiety, or boredom. It is often characterized by cravings for specific foods, especially sugary or fatty foods.
Learned Hunger: This type of hunger is caused by environmental cues, such as the sight or smell of food. It is often associated with eating habits and routines.

In addition to these five main types of hunger, there are also several other factors that can influence hunger, such as hormones, genetics, and sleep.

THE ANGRY

The angry, on the other hand, are driven by a sense of injustice or frustration. They feel that they have been wronged or deprived of something they deserve. Their anger is often a reaction to external circumstances or perceived threats.

When we are angry, we are more likely to be impulsive and reactive. We may lash out at others or engage in destructive behaviors. Our anger can cloud our judgment and make it difficult to think clearly.

There are many different types of anger, each with its own unique triggers and expressions. Some of the most common types of anger include:

Irritability: This is a mild form of anger that is often characterized by feelings of annoyance, frustration, or impatience. It is often caused by minor inconveniences or hassles.
Hostility: This is a more intense form of anger that is often characterized by feelings of resentment, bitterness, or hatred. It is often caused by perceived threats or injustices.
Rage: This is the most extreme form of anger, and it is often characterized by feelings of fury, violence, and destruction. It is often caused by major traumas or losses.

Other types of anger include:

Passive-Aggressive Anger: This type of anger is expressed indirectly, through behaviors such as procrastination, sarcasm, or withholding affection.
Explosive Anger: This type of anger is characterized by sudden, intense outbursts that are often out of proportion to the situation.
Chronic Anger: This type of anger is a persistent state of anger that can last for weeks, months, or even years. It is often caused by unresolved traumas or conflicts.

It is important to note that anger is not always a negative emotion. In some cases, anger can be a healthy response to injustice or wrongdoing. However, it is important to express anger in a healthy way that does not harm yourself or others.
It is therefore very important to know the reasons and the motives behind your anger.

THE DIFFERENCE

The key difference between the hungry and the angry lies in their underlying motivations. The hungry are driven by a need, while the angry are driven by an emotion. This distinction is crucial because it determines how we respond to them.

When we encounter someone who is hungry, we can offer them support and assistance. We can help them to meet their needs and alleviate their suffering.

However, when we encounter someone who is angry, we need to approach them with caution. We need to understand the source of their anger and try to address it in a constructive way. Simply reacting to their anger with anger will only escalate the situation.

CONCLUSION

Recognizing the difference between THE HUNGRY and THE ANGRY is essential for fostering healthy relationships and creating a more compassionate society. By understanding the motivations behind their actions, we can respond to them in a way that is both helpful and respectful.

As I reflect on this concept, I am reminded of the importance of empathy and understanding. By putting ourselves in the shoes of others, we can better appreciate their perspectives and respond to them with compassion. Hunger and anger can be constructive or Creative depending on the level of maturity and understanding of the affected or infected individual.

Therefore, in any political, religious or traditional society or organisation, the leadership and the followership have the responsibilities of constituting the act of mutual understanding and respect in order to maintain a stable and productive and prosperous environment.

And most importantly, irrespective of your status, it is mandatory, in the light of the above explanation about THE HUNGRY and THE ANGEY, for you to know your situation and limitations because both hunger and anger are naturally phenomenon but how we respond, react and manage them mark the difference, noting that, it is possible to be HUNGRY and never be ANGRY.

LET THE THIRD TIER BREATHE

IMPLICATIONS OF THE SUPREME COURT VERDICT

By Bayo Onanuga

The Supreme Court judgement on July 11, granting financial autonomy to the 774 local councils and recognising them as the third tier of Nigeria’s governance architecture, was truly historic. It was perhaps the most remarkable judgement ever delivered by the apex court in recent times, as it used its power to interpret the law to give a different meaning to Section 162 of the Constitution.

Since 1999, governors have used this section to withhold and tamper with the funds federally allocated to the councils, using a joint account that has proven to be a honeypot of abuse.

Last Thursday, the Supreme Court described the payment of the allocations to the account as gross misconduct and scolded the governors for dissolving democratically elected councils and setting up caretaker committees.

The court ruled that caretaker committees are illegal and that councils run by them should not receive the federal allocation.

Henceforth, the court ruled that the allocations should go directly to the accounts of the 774 local councils.

Justice Emmanuel Agim, who read the lead judgment, said Nigeria runs a three-tier governance structure, where no one tier is subject to the whims and caprices of the other. He criticised the governors and the state assemblies for almost allowing the councils to go into extinction with their treatment of them.

The judgment was generally well received by Nigerians. According to reports, the verdict ignited jubilation by workers in some local councils as they sang the praises of the Tinubu administration.

However, some Nigerians have criticised it as an ‘assault’ on Nigeria’s Federalism as it has rewritten Section 162. My simple response to this school of thought is: Must we allow the law to stand still while the local councils die? The Supreme Court also said as much: Since the governors were using the section to perpetuate unconstitutional acts, the court must ensure that the constitution is not applied in a manner that supports its destruction.

In acknowledging the verdict's import, former vice-president Atiku Abubakar described it as a win for the people. In a post on X, Atiku wrote: “The court’s ruling is a step in the right direction and a major corrective action in greasing the wheels of national development across the country... The court's verdict is in tandem with the core functions of the Supreme Court as an arbitration court between and among governments.”

President Bola Tinubu, whose government instituted the case, welcomed the Supreme Court's decision, affirming the spirit, intent, and purpose of the Constitution regarding the statutory rights of local governments.

"My administration instituted this suit because of our unwavering belief that our people must have relief, and today's judgement will ensure that only those local officials elected by the people will control the resources of the people. This judgement is a resounding affirmation that we can use legitimate means of redress to restructure our country and economy to make Nigeria a better place to live in and a fairer society for all of our people.”

President Tinubu noted that the provision of some essential amenities and public goods, such as the construction and maintenance of roads, streets, street lighting, drains, parks, gardens, open spaces, and other residual responsibilities, including community security, has been abandoned owing to the emasculation of local governments.

He said the court's decision to grant financial autonomy to the councils and restate other constitutional principles reinforced the effort to enhance Nigeria's true federal fabric for the development of the entire nation.

President Tinubu and his administration deserved the praise. President Tinubu has earned double appreciation as a defender of the local councils. As governor of Lagos, he sought the intervention of the same Supreme Court to establish the right of states to create councils in compliance with the provisions of the constitution. In a reverse role, as president, he has succeeded in seeking another intervention of the apex court to establish the right of the councils to survive and perform the role envisaged by the constitution.

Former President Muhammadu Buhari had sought to rescue the councils from the governors' vice grip by using Executive Order 10, which he signed on May 22, 2020, to direct funds straight to the councils, the state legislature, and the judiciary. But the governors challenged his authority in a case filed at the Supreme Court. In a split judgment in 2022, the Supreme Court said President Buhari overreached his powers.

SONG BY DAVE MUSICπŸ‘‡πŸ‘‡πŸ‘‡

In his lamentation, while signing the executive order, President Buhari said: “If the money from the Federation Account to the state is about N100 million, N50 million will be sent to the chairman (of local government), but he (the chairman) will sign that he received N100 million. The governor will pocket the balance and share it with whoever he wants to share it with. Then, the chairman of the local government must pay salaries. Go to hell with development. When he pays salaries, he will put the balance in his pocket. This is what’s happening in Nigeria.”

President Tinubu, his successor, sought to combat the problem constitutionally by suing the governors.

The Attorney General and Justice Minister, Lateef Fagbemi, approached the Supreme Court in May, seeking to compel the governors of the 36 federating states to grant full autonomy to local governments in their domains in a suit marked SC/CV/343/2024. The suit, anchored on 27 grounds, accused the state governors of gross misconduct and abuse of power. He prayed that the Supreme Court would make an order stating that funds standing to the credit of local governments from the Federation Account should be paid directly to the local governments rather than through the state governments.

The justice minister also requested an order restraining governors, their agents, and privies from receiving, spending, or tampering with funds released from the Federation Account for the benefit of local governments when no democratically elected local government system is in place in the states.
The court granted his prayers in the landmark ruling of July 11.

President Tinubu has always been concerned about the lack of governance at the grassroots. He believes that without fixing the problems at the councils, the objective of developing the country and spreading prosperity to the 200 million people will never be achieved. After all, the councils where the 200 million people live have been financially handicapped by the governors. He made the point clearly when he met in Abuja with the leaders of the Arewa Consultative Forum on May 30, about the same period when the Justice Minister approached the Supreme Court for the correct interpretation of Section 162.

President Tinubu, responding to the ACF's demands for more roles by the Federal Government, urged the leaders to summon the governors. He said Nigeria, as a constitutional democracy, has not allowed the councils where we all live to flourish, citing the absurdity of politicians going to the locals for votes only to abandon them and leave for the capitals and Abuja after winning their votes.

As Nigerians celebrate the historic judgment, it is clear that some work still needs to be done to bring life back to the councils. One issue being raised is how to ensure that the council elections are truly competitive and not predetermined by the governors and the state independent electoral commissions. To solve this, some Nigerians have urged the National Assembly to pass a law that will require only the central Independent National Electoral Commission to conduct council elections.

The other problematic issue is the fear that governors will not allow the Supreme Court ruling to affect their domains, as they can always order the councils to send the money received from the Federal Accounts Allocation Committee back to the state coffers. Again, a solution to this possible abuse has been proffered. The EFCC, ICPC, and NFIU should prevent this by monitoring the councils' accounts. While the governors enjoy immunity to cover their actions, the council chairmen and councillors do not have such cover as they can be arrested, tried, and jailed. The threat of arrest and prosecution can deter local political actors from collaborating with the governors.

In conclusion, while Nigerians await the full implementation of the Supreme Court verdict, one needs to appeal to the powerful governors to allow the councils to breathe. It is in the interest of the states to allow the blossoming of the third tier of government as it was before 1999.

Here are some of the benefits that the states should not let slip away:

First, local governments will now have more control over their finances, which could lead to improved service delivery and governance at the grassroots level.

Second, with greater financial autonomy, local governments can provide better services to their constituents, such as healthcare, education, and infrastructure development. This will reduce the pressure on the state government from the people expecting such minimal provisions.

Third, the judgment could lead to greater accountability and transparency in local government administration.

As President Tinubu remarked after the landmark ruling, “The onus is now on local council leaders to ensure that the broad spectrum of Nigerians living at that level are satisfied that they are benefiting from people-oriented service delivery.

"The Renewed Hope Agenda is about the people of this country, at all levels, irrespective of faith, tribe, gender, political affiliation, or any other artificial line they say exists between us. This country belongs to all of us. By this judgment, our people, especially the poor, can hold their local leaders accountable for their actions and inactions. What is sent to local government accounts will be known, and services must now be provided without excuses".
